China’s anti-dumping investigation into U.S. chips, ordered to truthfully fill out questionnaires within 37 days
China takes another move in retaliation against the United States. The Trade Remedy and Investigation Bureau of the Ministry of Commerce of China issued a notice on the 22nd, requiring all Chinese and foreign manufacturers, importers and exporters of related analog chips originating in the United States to fill in the anti-dumping investigation questionnaire from today, and must "fill it out truthfully" and submit "complete and accurate answers" within 37 days from the date of the questionnaire issuance (i.e., the 22nd).
China’s Ministry of Commerce announced on September 13 that it would conduct an anti-dumping investigation into imported analog chips originating in the United States. The outside world generally believed that this was China's retaliatory measure against the U.S. Department of Commerce's Bureau of Industry and Security's inclusion of 23 Chinese companies on the export control entity list on the same day on the grounds of national security.
The Paper reported that the Trade Remedy and Investigation Bureau of the Ministry of Commerce of China issued the "Notice on Issuing Questionnaires on Related Analog Chip (Chip) Anti-dumping Cases" on the 22nd, making the above provisions.
According to this notice, the questionnaires for this case (anti-dumping investigation on imported analog chips originating in the United States) are divided into three categories: foreign exporter or manufacturer questionnaire, Chinese domestic producer questionnaire, and Chinese domestic importer questionnaire.
The notice states that foreign exporters or manufacturers should fill in the foreign exporter or manufacturer questionnaire as required; Chinese domestic producers should fill in the domestic producer questionnaire as required; Chinese domestic importers should fill in the domestic importer questionnaire as required.
This notice emphasizes that "the date the notice is issued is the date the questionnaire is distributed." Relevant stakeholders should, as required, "truthfully fill in the questionnaire within 37 days from the date of distribution" and submit "complete and accurate answers."
The notice threatened that if the answers to the questionnaire are not provided within the prescribed time limit, or other circumstances stipulated in Article 21 of China's "Anti-dumping Regulations" exist, the investigation agency may make a ruling based on "obtained facts" and "the best available information."
This notice requires that relevant stakeholders should submit an electronic version of the answer sheet through the "Trade Remedy Investigation Information Platform" and, according to the requirements of the investigation authority, submit a paper version and a CD at the same time. The content of the electronic version and the paper version should be the same, and the format should be consistent.
